Terms, in plain words.
The rules for using this website and the default terms for working with us. A signed proposal or contract always takes priority.

1. About these terms
This website, dahmion.com, is operated by DAHMION TECHNOLOGIES (“DAHMION”, “we”, “us”), a micro enterprise registered under the Government of India’s Udyam (MSME) scheme, based in Delhi, India. By using this website or engaging our services, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to do so.
2. Using this website
- The content on this site is general information about our services. It is not professional advice and not a binding offer.
- You may not copy, scrape for resale, reverse-engineer or misuse this website, attempt to break its security, or use it for anything unlawful.
- Links to third-party websites are provided for convenience; we are not responsible for their content.
3. Engagements
Every engagement — a launch sprint, a monthly retainer or a one-off project — is defined in a written proposal, statement of work or contract (the “Agreement”), which sets out scope, deliverables, timelines, fees and approvals. If the Agreement conflicts with these terms, the Agreement wins.
4. Your responsibilities as a client
- Give us accurate information, timely feedback and approvals, and access to the accounts and materials we need.
- Make sure the products, claims, offers and materials you ask us to promote are lawful and that you hold the rights to any content you provide.
- Comply with advertising rules that apply to your category — including ASCI guidelines in India and, for healthcare, cosmetics and financial products, the relevant sector regulations.
- Pay invoices on time.
5. Fees, invoices and taxes
- Fees are as stated in the Agreement. Retainers are invoiced monthly in advance; projects and sprints are typically invoiced 50% upfront and 50% on delivery, unless agreed otherwise.
- Invoices are payable within 7 days unless the Agreement says otherwise. Late payments may pause work.
- Prices exclude GST and other applicable taxes, which are added where required. International clients are invoiced in the agreed currency; bank and conversion charges are borne by the payer.
- Advertising budgets (media spend) are paid by the client directly to the ad platform, or passed through at cost if agreed in writing — they are separate from our fees.
6. Intellectual property
- Once paid for in full, final deliverables we create specifically for you — content, designs, copy, campaigns — belong to you, including source files where the Agreement includes them.
- Ad accounts, pixels, analytics, social profiles and data are set up in your name and remain yours.
- We keep ownership of our pre-existing know-how, templates, frameworks and tools, and grant you a licence to use anything of ours that is built into your deliverables.
- Unless you tell us otherwise in writing, we may mention you as a client and show work we made for you in our portfolio after it is public. We will never publish your results or metrics without your written approval.
7. Confidentiality
Each party will keep the other’s non-public business information confidential and use it only for the engagement. This continues for three years after the engagement ends. We are happy to sign a mutual NDA before any detailed discussion.
8. Third-party platforms
Campaigns run on platforms such as Google, Meta, LinkedIn, Amazon and WhatsApp, which have their own policies and can change their rules, pricing, algorithms or approve and reject ads at their discretion. We are not responsible for platform decisions, outages or account restrictions outside our control, but we will help you resolve them.
9. No guaranteed results
Marketing results depend on many factors outside our control — your product, pricing, market, competition and platform changes. We commit to doing the agreed work with skill and care, but we do not guarantee specific rankings, reach, followers, leads, sales or return on ad spend. See our Disclaimer.
10. Limitation of liability
To the extent permitted by law, neither party is liable for indirect or consequential losses, such as lost profits or lost data. Our total liability under any engagement is limited to the fees you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot legally be limited.
11. Ending an engagement
Retainers can be ended by either party with 30 days’ written notice, unless the Agreement says otherwise. There are no lock-in periods. On ending, we hand over all your accounts, files and data. Refunds are covered in our Refund & Cancellation Policy.
12. Force majeure
Neither party is responsible for delays caused by events beyond reasonable control, such as natural disasters, government action, internet or platform outages.
13. Governing law and disputes
These terms are governed by the laws of India. We will first try to resolve any dispute by good-faith discussion within 30 days. If that fails, disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator, seated in New Delhi, in English. Subject to this, the courts of Delhi have exclusive jurisdiction. International Agreements may specify a different arrangement.
14. Changes
We may update these terms from time to time; the date at the top shows the latest version. Changes do not affect Agreements already signed.
